Assumption of Risks & Release of Liability for Negligence

PLEASE READ CAREFULLY – THIS IS A WAIVER OF LEGAL RIGHTS

Riding a bicycle and participating in a group bike ride or bike event that traverses public roads and trails is a risky activity. These risks include the risks inherent in riding a bicycle in traffic - potentially negligent driver - the possibility of an accident with traffic, uneven surfaces or confusing signage -traversing trails with varying surfaces – weather – wildlife – pedestrians - other riders. You can fall, be hit by a car, ride off the road, ride off the trail, be hit by a fellow bike rider, be attacked by a bear or a moose, or be injured by a variety of risks that exist in the world.

By signing this Assumption of Risks & Release of Liability for Negligence, I voluntarily assume all risk of death, physical or mental injury, or property damage associated with my participation in this ride.

By agreeing to participate in this ride, I ALSO voluntarily accept the risk that the organizers may be NEGLIGENT in their performance of their duties associated with putting on a bicycle race. This negligence is beyond the inherent risks of Anchorage bicycle riding or group rides. This risk is the reality that the organizers do not claim to be perfect nor able to anticipate all dangers or risks that may befall participants. Organizers may make a mistake and that mistake may result in injury or death.

In consideration of being allowed to participate in this ride I accept the risk that I may be killed or injured and waive any right to sue Trek Bicycle Store of Anchorage, its owners, or employees for any NEGLIGENCE on their part.

In plain and simple language: If you do not want to assume all of these risks and forever release the Trek Bicycle Store of Anchorage, do not sign this document and do not participate in our bike event.

I am aware that this Release of Liability and Assumption of Risks is a binding contract between me and the Trek Bicycle Store of Anchorage. I am signing this release on my own behalf and on behalf of my heirs and assigns.

Additionally, I shall indemnify, SAVE HARMLESS and defend the Youth Exploring Adventure Inc. dba Hilltop Ski Area, its officers, agents and employees from LIABILITY of any nature or kind, including cost and expenses, for or on account of any and all legal actions or claims of any character whatsoever resulting from injuries or damages sustained by any person or persons or property as a result of any error, omission or negligent act of the permittee relating to the use of the facility/park.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
